Notice to Purchasers & Users
By registering with this website, creating an account, purchasing or using products or services you acknowledge and accept these Terms and Conditions and agree to be bound by them.
Terminology & Interpretation
In these Terms and Conditions:
- “Details” means the User information required to enrol them into the LMS.
- “Duration” means the LMS access period of the Product.
- “LMS” means the Learning Management System.
- “Products” means all products and services supplied via iPASS.
- “Purchaser” means the party purchasing Products from iPASS.
- “User” means the Purchaser or other person who will use the Product.
Terms & Conditions
Acceptance
- During the process to register with this website and create an account the Purchaser is required to acknowledge and accept these Terms and Conditions.
Pricing & Tax
- iPASS Products are priced in US Dollars (USD) unless explicitly stated otherwise.
- iPASS is based in New Zealand. Where the Purchaser is located in New Zealand then all prices, fees, and costs include GST.
Technical
- The Products are delivered via an online LMS.
- To access the LMS and use the Products the User must have:
- A reliable internet connection
- A suitable computer device (desktop PC, laptop, tablet, or capable mobile device)
- Speakers or headphones and a microphone
- A suitable web browser (it is recommended to use Google Chrome or Mozilla Firefox as some Product features may not work as desired on other browsers)
- iPASS does not provide the above items and takes no responsibility for their supply or lack of availability.
Products & Use
- Products are supplied to the Purchaser with limited rights of use but no rights of ownership.
- Products purchased by the Purchaser are for use by themselves or their designated User, Products may not be on-sold to, or used by, any other party.
- The purchase of a Product is “per User per Product per Duration”.
Cancellation, Extension, Transfer, Repeat & Refund
- In all circumstances the supply of Products to the Purchaser does not provide for cancellations, extensions, transfers, repeat use, or refunds.
- iPASS does not provide any way to discontinue, pause, extend, or transfer the use of Products.
- iPASS accepts no responsibility or liability for Users who do not use their Products or complete the use of their Products within the Duration.
User Details & Course Certificate
- The Purchaser is responsible for the provision of accurate User Details at the time of Purchase.
- The LMS automatically generates Course Certificates for Users based on the User Details supplied at the time of purchase.
- Changes to User Details may be possible, at the discretion of iPASS, within 2 weeks of purchase where such changes may attract a service fee from iPASS.
- The Purchaser accepts that User Details may necessarily be provided to third-party suppliers to enable the use of their Products.
User Age & Language
- iPASS Products are intended for Users who are 15 years of age or older due to the educational material targeting Users who are starting to develop their career path or study choices for tertiary education. The Purchaser may, at their own discretion and risk, use iPASS products for Users who are younger than 15 years of age. In any event iPASS takes no responsibility for the User’s comprehension or understanding of the material.
- iPASS Products are developed in English and are intended to be delivered in English. The User may, at their own discretion and risk, change the language settings in the LMS or use their web browser to translate the Product into a language other than English. iPASS makes no representations or guarantees about LMS or web browser translations and takes no responsibility for the outcomes of any such translations.
- In any circumstance iPASS is unable to accept any responsibility for the engagement, understanding, or comprehension of Users who must accept responsibility of their own learning process and outcomes.
Governing Law, Disputes & Liability
- These Terms and Conditions are governed by the laws of New Zealand.
- Any dispute arising out of these Terms and Conditions or use of the Products must be brought and heard in New Zealand through a resolution process of negotiation, mediation, and arbitration between the Purchaser and iPASS.
- In all circumstances iPASS accepts no liability for the Purchaser’s or User’s use of the Products or learning outcomes.
